England and Wales are not one jurisdiction for possession work. Using the English process on a Welsh property does not weaken a case, it produces no case at all.
For landlords and agents whose portfolios cross the border, the single most expensive assumption is that a process which works in Shropshire will work in Powys. Wales has run its own system since December 2022, and the vocabulary alone should be a warning.
Different words for different things
Wales does not have tenants and tenancies in the way England does. It has contract-holders and occupation contracts, and the documents that govern them are written to the Renting Homes (Wales) Act 2016. An English form used on a Welsh property is not a near miss.
The written statement
The written statement of the occupation contract has to be issued within a set period. Where it was late, incomplete or never issued at all, that failure can undermine a possession notice regardless of how much rent is owed.
Fitness for human habitation
In Wales, a dwelling that is not fit for human habitation, or where the required safety checks cannot be evidenced, can void a notice outright. This is a matter of the landlord's own compliance record, not the occupier's conduct.
Where this bites
Agents managing stock on both sides of the border tend to run two compliance regimes with one set of office habits. That is where the claims come from, and it is a training problem as much as a legal one.
The practical answer is to establish, before anything is drafted, which country the property is in and which framework applies. Everything downstream depends on that answer.
