Eviction specialist
Specialist support with possession, tenancy disputes and everything in between.
Waymakers Legal Services supports landlords and agents with evictions and landlord and tenant disputes across England and Wales.
Waymakers Legal specialises in challenging possession cases, particularly where an occupier refuses to leave, proceedings are defended or disrepair allegations complicate the claim.
These cases require a detailed assessment of the occupation arrangements, the available grounds, compliance, the procedural history and the evidence.
Where a tenant or occupier will not leave, the correct legal process must be followed. A mistake can mean starting again, and removing a tenant without a court order exposes a landlord to an unlawful eviction claim and criminal penalties. The team handles the whole process, from checking the tenancy and serving a valid notice through to the possession hearing and enforcement.
1. Serving the right notice
Each notice has strict requirements for its form, content, notice period and service. The team checks the tenancy or occupation contract and the compliance history, including deposit protection, gas safety and energy performance, before preparing and serving the notice that fits the case.
2. Court proceedings
If the occupier has not left when the notice expires, Waymakers issues a possession claim and, where rent is owed, a claim for the arrears. Claims are prepared carefully from the outset, because a defect found at the hearing can mean beginning again.
3. Enforcement
Once a possession order has been made and the date for leaving has passed, the order is enforced by County Court bailiffs or, with the court's permission, by High Court Enforcement Officers.
Complex and defended possession claims
Advice is available on challenging tenant disputes, breaches of tenancy or occupation contract, disputed occupation and cases involving unauthorised occupiers or subletting.
Where notices have already been served or proceedings have started, the team reviews the existing position and advises on the steps needed to move the matter forward.
Disrepair allegations
Disrepair allegations can raise significant questions about liability, evidence and the conduct of possession proceedings.
The team helps clients assemble inspection records, repair histories and correspondence so that the allegations can be properly assessed. Waymakers advises on the response and any associated defence or counterclaim, considering both the repairing issues and their effect on the wider dispute.
Access disputes
Where access for inspections, safety checks or repair work is being refused, the team helps clients document their efforts and communicate the requirements clearly. Advice is provided on appropriate legal action where the issue remains unresolved.
Rent arrears
Support is available with rent arrears alongside possession proceedings and with the recovery of unpaid rent.
This includes reviewing the rent account, identifying disputed sums and considering the practical prospects of recovery before deciding how to proceed.
England and Wales
For Welsh properties, Waymakers Legal provides specialist advice on occupation contracts, notices, possession and compliance under the Renting Homes framework.
For English properties, advice covers the applicable tenancy arrangements, possession routes, notices and compliance requirements, including the effect of the Renter’s Rights Act.
In England, section 21 notices can no longer be used for assured tenancies from 1 May 2026, and possession depends on the grounds in Section 8 as amended by the Renters' Rights Act.
Related matters
The team also advises on allegations of unlawful eviction or harassment, forfeiture of commercial leases, company lets, deposit protection disputes and breaches of tenancy terms.
